NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR SURVEY COMPLETION WILL NOT INCREASE YOUR CHANCES OF WINNING. ONLINE ENTRY AND THE ALTERNATE METHOD OF ENTRY ARE THE ONLY METHODS OF ENTRY. VOID WHERE PROHIBITED.
These Official Rules govern the Granite City Electric Supply September 14th through October 2nd Sweepstakes (Voice of the Customer Sweepstakes) for the relevant Promotion Period herein (the “Promotion”).
Granite City Electric Supply Company (“GCE” or “Sponsor”), with an address at 19 Quincy Avenue, Quincy, MA 02169.
The Sweepstakes is administered on Sponsor’s behalf by Adience (“Administrator”). The Administrator is responsible for survey administration, the random drawing, winner selection, and prize fulfillment.
The Promotion begins at 9am EDT on September 14th and ends at 5pm EDT on October 2nd (the “Promotion Period”).
The Sweepstakes entry is to complete the GCE Voice of the Customer survey during the Promotion Period.
During the Sweepstakes Period, eligible individuals who receive Sponsor’s customer survey invitation may enter the Sweepstakes by completing and submitting the survey in accordance with the instructions provided. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a Prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor.
If you are not an existing customer of GCE, or did not receive a survey invitation from Sponsor, you may still enter the Sweepstakes for free by mailing a 3” × 5” card (or postcard) with your full name, mailing address, email address, and phone number to: GCE Sweepstakes Entry, 19 Quincy Avenue, Quincy, MA 02169. Mail-in entries must be postmarked no later than October 2nd and received no later than October 9th to be eligible. Limit one (1) entry per person regardless of method of entry. Mail-in entries will receive the same chance of winning as entries submitted via survey completion. All entries, regardless of method, will be treated equally in the drawing.
Upon successful submission during the Sweepstakes Period, an eligible individual will receive one (1) entry into the Sweepstakes. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of the Sponsor.
Participation in the underlying customer satisfaction survey is voluntary and is governed by separate survey disclosures. Entry into the Sweepstakes is not conditioned on any particular substantive response to the survey, and the chance to enter the Sweepstakes does not depend on the content of any Entrant’s survey responses.
The Promotion is open to legal residents of the United States and the District of Columbia who are 18 years of age or older, or the age of majority in their state of residence, whichever is greater, at the time of entry; and either:
(a) are associated with an existing customer of Granite City Electric Supply Company and receive an invitation from Sponsor to participate in the customer survey, or
(b) submit an entry via the Alternate Method of Entry described in Section 4 above.
Employees of GCE and any of its advertising and promotional agencies, including the Administrator (Adience) and its employees, any other entities participating in the design, marketing, administration, or fulfillment of this Promotion, as well as each of their parent corporations, subsidiaries, and affiliated companies (collectively with GCE, the “Promotion Entities”), and each of their immediate families and members of their households are ineligible to participate in this Promotion. Void where prohibited.
For purposes of these Official Rules, the entrant is the individual who completes and submits the survey, rather than the company, employer, or organization with which that individual is associated. Any Prize will be awarded to the individual Winner and not to his or her employer or organization.
The potential Prize Winners will be selected by a random drawing conducted by the Administrator (Adience) within 15 days after the close of the Promotion Period from among all eligible Entrants.
The Sponsor (GCE), whose decision is final and binding in all respects, will notify each selected Entrant through email (“Notice”) within 3 business days following the drawing (each a “Potential Prize Winner”).
Odds of winning the Prizes depend on the number of eligible entries received from Entrants during the Promotion Period.
If a Potential Prize Winner fails to respond to such notification within 7 days, is disqualified, or forfeits the Prize, an alternate potential winner will be selected by random drawing from remaining eligible entries.
Each Potential Prize Winner may be required to execute and return an Affidavit of Eligibility and a Liability/Publicity Release within 7 days of notification. Failure to return the required documents will result in forfeiture of the Prize and selection of an alternate winner.
AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED VERIFICATION IS COMPLETE (“Winner”).
Total Winners selected: Five.
Five Winner(s) will receive a $100 prepaid Visa® giftcard. Estimated retail value: $100.
The total estimated retail value of all Prizes (the “ERV”) is $500 USD cumulatively.
Winner(s) may not substitute, assign, transfer, or sell any Prize for cash or otherwise. GCE reserves the right, in its sole discretion, to substitute a Prize, or portion thereof, with one of comparable or greater value, or the cash equivalent if GCE is unable to provide the Prize.
Any applicable federal, state, and local taxes and liabilities arising from this Promotion are the sole responsibility of each Winner. Each Winner shall provide, upon Sponsor’s request, all available information that Sponsor or Administrator may reasonably require to fulfill obligations under any applicable tax statute, regulation, or rule, including IRS Form W-9. Winner acknowledges that Sponsor will rely upon such information to prepare all relevant tax materials, if any, including IRS Form 1099 if applicable.
This Promotion is subject to all applicable federal, state, and local laws of the United States. By participating, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, and waive any and all right to claim ambiguity in the Promotion or these Official Rules.
For purposes of these Official Rules, “Licensed Parties” means the Promotion Entities, and their licensees, affiliates, and assigns.
Entrants and Winners agree to release, discharge, indemnify, and hold harmless the Licensed Parties, Sponsor, Administrator, third-party platforms utilized in connection with the Promotion, and their officers, directors, employees, representatives, and agents from claims, damages, attorneys’ fees, costs, injuries, losses, or liabilities arising from participation or acceptance, possession, ownership, misuse, or use of any Prize.
ALL PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE OR, IF APPLICABLE, ANY PRIZE COMPONENTS, INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS OR ACTS OR GOVERNMENT OR AUTHORITY.
Each Entrant and Winner understands and agrees that all rights under Section 1542 of the California Civil Code and any similar law of any state or territory of the United States are hereby expressly waived. Said section reads as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
The Released Parties are not responsible for: (i) lost, late, misdirected, undeliverable or incomplete entries due to system errors or failure, or faulty transmissions or other telecommunications malfunctions and/or entries; (ii) technical failures of any kinds; (iii) failures of any of the equipment or programming associated with or utilized in the Promotion; (iv) unauthorized human and/or mechanical intervention in any part of the entry process or the Promotion; (v) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (vi) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or part, from Entrant’s participation in the Promotion or receipt or use of any Prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Promotion. If for any reason this Promotion is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of GCE which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then GCE reserves the right at its sole discretion to cancel, terminate, modify, or suspend all or any part of the Promotion and to select Potential Prize Winners from among all eligible entries received by GCE up until the time of such cancellation, termination, modification or suspension, as applicable.
To the extent permitted by applicable law, all judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental and/or consequential damages. In no event shall damages exceed the total estimated retail value of all Prizes ($500 USD) in the aggregate.
EXCEPT AS PROHIBITED BY LAW AND AS A CONDITION OF PARTICIPATING IN THIS PROMOTION, ENTRANT HEREBY WAIVES ANY RIGHT TO A TRIAL BY JURY IN RESPECT TO LITIGATION DIRECTLY OR INDIRECTLY ARISING OUT OF OR IN CONNECTION WITH THIS PROMOTION.
This Promotion is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules for this Promotion shall be governed by the laws of the State of Massachusetts, without regard to any principles of conflict of laws. Should there be a conflict between the laws of the State of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the State of Massachusetts. All disputes arising out of or connected with this Promotion will be resolved individually, and without resort to class action, exclusively by binding arbitration by a single arbitrator in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association, in Norfolk County, Massachusetts; provided, however, that either party may elect to pursue any individual claim in small claims court (or equivalent limited-jurisdiction court) in Norfolk County, Massachusetts, so long as the claim remains in such court and is not removed or transferred to a court of general jurisdiction. All parties shall bear their own attorneys’ fees and costs, except that GCE shall bear the arbitrator’s fees and expenses for any arbitration initiated by an Entrant or Winner; provided further that if the arbitrator determines the claim was frivolous or brought for an improper purpose, the arbitrator may reallocate fees as permitted by applicable law. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Notwithstanding the foregoing, nothing in this Section shall preclude either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.
By entering this Promotion, Entrant acknowledges that (a) personal information submitted in connection with the Promotion will be collected and processed by the Administrator (Adience) on behalf of the Sponsor (GCE); (b) survey responses will be anonymized and aggregated before being shared with GCE, and individual customer feedback will be shared with GCE only if the Entrant separately consents; (c) personal information collected in connection with the Sweepstakes will be shared between Sponsor and Administrator solely for purposes of administering the Sweepstakes and fulfilling the prizes; and (d) such information will be handled in accordance with the Administrator’s Privacy Policy, available at https://www.adience.com/privacy-policy/, and GCE’s Terms of Use, available at https://www.granitecityelectric.com/terms-of-use.
By participating, Entrant agrees that participation is subject to these Official Rules and, to the extent applicable, GCE’s Terms of Use. In the event of any conflict between these Official Rules and GCE’s Terms of Use, these Official Rules shall govern with respect to the Promotion.
If selected as a Winner, certain identifying information may be disclosed to third parties as required by law, including on a publicly available Winners List.
ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN DISQUALIFICATION AND TERMINATION OF ALL PRIVILEGES AS WINNER.
For the names of the Prize Winners or a copy of these Official Rules, send a self-addressed, stamped envelope to: GCE Sweepstakes, 19 Quincy Avenue, Quincy, MA 02169. If any provision of these Official Rules is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such invalidity, illegality, or unenforceability shall not affect the validity, effect, or enforcement of any other provision of these Official Rules.
If the Sweepstakes or any portion thereof is unable to be conducted as planned for any reason, including but not limited to pandemic, act of God, fire, flood, severe weather, labor dispute, governmental act, public health emergency, act of terrorism, or any other event beyond Sponsor’s reasonable control (each a “Force Majeure Event”), Sponsor reserves the right, in its sole discretion, to cancel, modify, suspend, or terminate the Sweepstakes without liability. In such event, Sponsor may, but shall not be obligated to, select Winners from among all eligible entries received prior to the Force Majeure Event.
